1. ACCEPTANCE OF TERMS

By accessing and using liftnasium.com (the "Site"), operated by Liftnasium LLC ("Liftnasium," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

2. USE OF THE SITE

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Site
  • Upload malicious code, spam, or inappropriate content
  • Interfere with or disrupt the Site's functionality
  • Scrape, crawl, or harvest data from the Site without permission

3. PRODUCTS AND ORDERS

Product Descriptions: We make every effort to accurately display our products, including images and descriptions provided by our vendor partners. Colors and dimensions may vary slightly from what is shown on screen.

Pricing: All prices are in USD and subject to change without notice. We reserve the right to correct pricing errors.

Order Acceptance: Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including product availability, pricing errors, or suspected fraud.

Vehicle Fitment: While we strive to provide accurate fitment data, it is your responsibility to verify that products are compatible with your specific vehicle. We recommend consulting a professional installer if you are unsure.

4. EMISSIONS, LEGAL USE, AND VEHICLE EQUIPMENT LAWS

Read this section before purchasing performance or suspension parts.

Some products sold on the Site are intended for off-road, racing, or competition use only and are not legal for use on emission-controlled vehicles operated on public roads. Federal law and the laws of California and other states that follow California Air Resources Board (CARB) standards restrict the sale and installation of certain emissions-related and performance parts for street use.

By purchasing, you agree that:

  • You are responsible for confirming that any product is legal to install and operate in your state and for your intended use.
  • Products labeled "off-road use only," "racing use only," or "competition use only" must not be installed on vehicles operated on public roads or highways where prohibited.
  • Lift height, bumper height, lighting, exhaust, and other vehicle equipment laws vary by state. You are responsible for compliance with the laws of your jurisdiction.
  • Liftnasium is not responsible for fines, penalties, failed inspections, or other consequences resulting from installation or use of products in violation of applicable law.

5. SHIPPING AND DELIVERY

Products are shipped directly from our vendor partners. Shipping times vary by product and vendor. We will provide tracking information when available. Liftnasium is not responsible for delays caused by carriers or customs.

6. RETURNS AND REFUNDS

Our return policy is shown at checkout and you must acknowledge it before completing your purchase. The policy is as follows:

  • Unused, unopened products may be returned within 30 days of delivery.
  • The customer is responsible for return shipping costs.
  • Installed or used products are not eligible for return.
  • Custom, special-order, and made-to-order items are non-refundable.
  • We do not charge a restocking fee on eligible returns.
  • Approved refunds are issued to the original payment method within 5 to 10 business days after we receive and inspect the returned product.

To start a return, contact us at support@liftnasium.com. Certain products shipped by vendor partners may be subject to the vendor's specific return terms, which we will provide before you complete a return.

7. INTERACTIVE GARAGE

The Interactive Garage vehicle configurator is provided for visualization purposes. Product images shown in the configurator are representative and may differ from the actual product. Configured vehicle images are simulations and are not guarantees of final appearance after installation.

8. USER-SUBMITTED CONTENT

By submitting photos or content to our gallery, you:

  • Grant us a non-exclusive, royalty-free license to display, reproduce, and share the content on our Site and social media
  • Represent that you own the content or have permission to share it
  • Agree that we may moderate and remove content at our discretion

We reserve the right to reject or remove any submission without notice.

9. INTELLECTUAL PROPERTY

All content on the Site, including logos, text, images, and design, is the property of Liftnasium LLC or our licensed partners and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without written permission.

10. DISCLAIMER OF WARRANTIES

The Site and all products are provided "as is" without warranties of any kind, express or implied, except as required by law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Product warranties, where offered, are provided by the respective manufacturers.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Liftnasium LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products. Our total liability shall not exceed the amount you paid for the specific product in question. Some states do not allow certain limitations, so parts of this section may not apply to you.

12. DISPUTE RESOLUTION AND ARBITRATION

Any dispute arising from these Terms or your use of the Site will be resolved by binding arbitration on an individual basis, except that either party may bring a claim in small claims court. You and Liftnasium waive the right to a jury trial and the right to participate in a class action. If any portion of this section is found unenforceable, the remainder stays in effect.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Subject to Section 12, any dispute not subject to arbitration shall be resolved in the state or federal courts located in Marion County, Indiana.

14. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
